Terms of Service

1. Agreement to Terms

By downloading, installing, or using Screen Buddy (the "Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the Application.

2. Description of Service

Screen Buddy is an AI-powered desktop application developed by Kapari AI that:

• Captures your screen on-demand when you ask it questions
• Uses AI to analyze and answer questions about your screen content
• Provides voice interaction for hands-free assistance
• Runs as a native macOS application

Screen Buddy does NOT continuously monitor your screen. Screen capture only occurs when you explicitly request it through voice interaction.

3. Account Registration

To use the Application, you must:

• Sign in using Google Sign-In
• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years of age
• Have the legal capacity to enter into this agreement

You are responsible for all activities that occur under your account.

4. Subscription and Payment

4.1 Subscription Plans

The Application is offered on a subscription basis. By subscribing, you agree to pay the monthly subscription fee as displayed at the time of purchase.

4.2 Free Trial

New subscribers may be eligible for a free trial period. During the trial, you will have full access to all features at no charge. You must provide a valid payment method to start the trial. At the end of the trial period, you will automatically be charged the subscription fee unless you cancel before the trial ends.

4.3 Billing

Subscriptions are billed monthly in advance. You authorize us to charge your payment method on file for all subscription fees.

4.4 Cancellation

You may cancel your subscription at any time through Stripe's customer portal. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

5. System Permissions

To function properly, Screen Buddy requires the following macOS permissions:

• Screen Recording: To capture your screen when you ask questions about it
• Microphone: To listen to your voice commands during active sessions

You can revoke these permissions at any time through macOS System Settings. Revoking permissions will disable the corresponding functionality.

6. Acceptable Use

You agree NOT to use the Application to:

• Violate any laws or regulations
• Capture or transmit content you don't have the right to share
• Capture sensitive information belonging to others without authorization
• Interfere with or disrupt the Application or our services
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the Application
• Use the Application for illegal purposes

7. Service Availability

We strive to provide reliable service, but we do not guarantee uninterrupted access. The Application may be unavailable due to maintenance, updates, API provider outages, or circumstances beyond our control. We are not liable for any service interruptions.

8. Intellectual Property

All content, features, and functionality of the Application, including but not limited to text, graphics, logos, and software, are owned by Kapari AI and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content on your screen that you share with the Application. You grant us a limited license to process this content solely to provide the service.

9. AI-Generated Content

The Application uses artificial intelligence to analyze your screen and generate responses. While we strive for accuracy, AI-generated content may occasionally be incorrect or incomplete. You are responsible for verifying important information provided by the AI.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAPARI AI SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Errors or inaccuracies in AI-generated responses
• Actions taken based on AI recommendations

Our total liability to you for any claim arising from your use of the Application shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Kapari AI from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the Application, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may suspend or terminate your access to the Application at any time, with or without cause, with or without notice. Upon termination, your right to use the Application immediately ceases. You may also terminate your account at any time by canceling your subscription and uninstalling the Application.

13. Privacy

Your use of the Application is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Application after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Application shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
